EAT decision
The Employment Appeal Tribunal dismissed Mr Osoba's appeal.
The EAT said it was hard to see what more Pritchard (who drew up the selection matrix) could have said. Pritchard did what she thought was right in accordance with the employer's policy and was exposed in the course of the hearing to the errors which she had made, which she accepted.
The EAT upheld the ET's finding that Pritchard had acted honestly, but did not accept that she had manipulated the selection process because of age.
